Common types of Chapter 7 and Chapter 13 bankruptcy-related issues and disputes include:
- Accusations of misconduct or criminal fraud: Making major purchases, taking out unsecured personal loans or providing false information to the bankruptcy court can all be grounds for a "dischargeability" complaint. If these claims are found to have merit, those otherwise dischargeable debts cannot be wiped out. Criminal charges may be filed as well.
- Contested Chapter 13 plans: Chapter 13 reorganization plans form another common basis for bankruptcy litigation. In these situations, a creditor, a soon-to-be ex-spouse, a trustee or a bankruptcy court judge may question the fairness of your plan and challenge or reject it.
- Post-bankruptcy creditor harassment: Creditors don't always take no for an answer — even with debts that have been legally discharged in bankruptcy. If you are continuing to be harassed by a creditor after having gone through the bankruptcy process, they are in violation of federal law and we can pursue remedies against them in court.
